How Does an Auto Accident Claim Work?
After the auto accident, a claim needs to be set up with the insurance company. We are happy to do that for you, but there is no problem with you handling it on your own. We ask that you do not give a recorded statement and do not talk in any detail about your injuries. Since your own PIP (no Fault) insurance will be triggered, you will have to fill out the application. We can help you with this too, but it is pretty simple. PIP will pay up to $10,000 toward your medical bills, so you have a cushion for your treatment. Don’t worry, your car insurance rates will not go up because PIP pays your bills.
Your medical treatment is perhaps the most important part of the case. Depending on your situation, we will refer you to medical professionals who are experienced with auto accident injuries. Your family doctor or general practice physician is not appropriate for auto accident claims and many won’t even touch them. We then let your medical providers handle your medical treatment while we monitor it. At the same time, we will find out the insurance limits and make sure that your bills/treatment are in line with the available coverage.
At the conclusion of your treatment, we then file a demand on the insurance company. After some negotiation with your bills and the insurance company, the vast majority of claims settle.
Will I have to File a Lawsuit?
No. This is a big misconception when people consider whether to hire a lawyer for their injury claim. There are a few things to know. First, at least 90% of injury claims result in a settlement after only a few months. Second, the claim is against the person’s insurance company. This means that the at-fault person never has to pay anything out of pocket. Their insurance company will pay their claim and even pay for a lawyer for them. So, you do not need to feel guilty about making a claim. Third, a lawsuit is a last resort and always done with your consent. If your case cannot be settled, you and only you have the option of taking the next step and filing a lawsuit. Out of these lawsuits, almost every one is settled before going to trial.
